1.2. This privacy policy (together with any terms and conditions applicable to any goods and/or services we supply) sets out the basis on which any Personal Data we collect from you, or that you provide to us, through your use of our Sites, will be processed by us.
1.3. Please read the following carefully to understand our views and practices regarding your Personal Data and how we will treat it.
1.4. This policy has been prepared to take account of the forthcoming changes under GDPR. We may change this policy from time to time to take account of:
1.4.1. changes to Data Protection Laws and other laws which may affect this policy
1.4.2. guidance issued by the ICO and others;
1.4.3. issues raised by our customers, partners and end users.
1.5. Accordingly, we suggest that you regularly check this page to ensure that you continue to be comfortable with the measures that we are taking to protect your privacy. This policy is effective from 24th May 2018.
2. Definitions used in this policy
2.1. In this policy the following words have the following meanings:
Act means the Data Protection Act 1988
Customer, you and your: means any of the following (a) subscribers to our Publications (b) customers who have entered into a contract with us for the supply of our products and services (c) attendees at our events (d) attendees at awards (e) editorial contributors.
Data Protection Laws means the Act, GDPR, the Regulation of Investigatory Powers Act 2000, the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000 (SI 2000/2699), the Electronic Communications Data Protection Directive (2002/58/EC), the Privacy and Electronic Communications (EC Directive) Regulations 2003 (SI 2426/2003) and all applicable laws and regulations relating to the processing of personal data and privacy, including where applicable the guidance and codes of practice issued by the ICO or any other supervisory authority, and the equivalent of any of the foregoing in any relevant jurisdiction.
Data Controller, Data Processor, Data Subject and Personal Data all have the meaning given to them in the Act and GDPR
Events means awards, conferences, competitions, exhibitions, roundtables, polls, surveys managed by the Group
GDPR means EU General Data Protection Regulations
Group means the Rapid News Group of companies (including Rapid News Publications Limited (CRN 02721194), Rapid Life Sciences Limited (CRN 04327046), Rapid Plastics Media Limited (CRN 06779639), Rapid Medtech Communications Limited (CRN 10463739) Interplas Events Limited (CRN 09153942), Euro Publishing Consultancy Limited (CRN 04494404) and Packaging Europe Limited (CRN 10531302) whose registered offices are at No.3 Office Village, Chester Business Park, Chester, England, CH4 9QP) , any subsidiary or any holding company from time to time of any Group company, and any subsidiary from time to time of a holding company of the Group. A reference to a holding company or a subsidiary means a holding company or a subsidiary (as the case may be) as defined in section 1159 of the Companies Act 2006.
ICO means the Information Commissioner’s Office and any successor to it as data protection authority.
Content and Information Services means market research, surveys, polls, market analysis.
Publications means printed publications, digital publications, magazines, and e-newsletters published by the Group.
Site(s) means any of the Group’s websites including this website.
3. Data Controller
3.1. The Group is made up of different legal entities. This privacy notice is issued on behalf of the Group so when we mention "Company", "we", "us" or "our" in this privacy notice, we are referring to the relevant company in the Group responsible for processing your data. We will let you know which entity will be the controller for your data when you purchase a product or service with us.
3.2. We have appointed a data privacy manager who is responsible for overseeing questions in relation to this privacy notice. If you have any questions about this privacy notice, including any requests to exercise [your legal rights], please contact the data privacy manager using the details set out below.
3.3. Should we ask you to provide certain information by which you can be identified when using our Sites, subscribing for any of our Publications, our products or services or by other contact methods, then you can be assured that it will only be used in accordance with this privacy policy.
3.4. As Data Controller, we determine the purposes for which and the manner in which your Personal Data is, or is to be, processed.

4.2.5. Transaction Data – this will:
4.2.5.1. include information which you are required to provide to us in connection with your purchase of Publications, subscriptions, events, Content and Information Services, products and services from us such as your name, address, email address, telephone number, card details and transaction details;
4.2.5.2. be supplied by you at the point of purchase;
4.2.5.3. be processed for the purpose of supplying you with the Publications, subscriptions, products and/or services you have purchased; record-keeping purposes; marketing purposes
4.2.6. Notification Data – this will:
4.2.6.1. include information which you are required to provide to us for the purpose of subscribing to free email notifications, newsletters etc (Notifications);
4.2.6.2. be supplied by you when you subscribe for such Notifications;
4.2.6.3. be processed by us for the purpose of sending you such Notifications as well as notifications from our Group and selected third parties.
4.2.7. Attendee Data – this will:
4.2.7.1. include information which you are required to provide to us for the purpose of attending any of our Events
4.2.7.2. be supplied by you, or your employer, when you register to attend an event;
4.2.7.3. be processed by us for the purpose of completing your registration for an event, sending you event details and notifications, reminders, entry badges and details which are an integral part of the event.
4.2.8. Marketing and Communications Data – this will include your preferences in receiving marketing from the Group and our third parties and your communication preferences.
4.3. Information we collect about you.
Whenever you access the Site we will automatically collect the following information:

5. How we use your personal data
5.1. We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
5.1.1. Where we need to perform the contract we are about to enter into or have entered into with you.
5.1.2. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
5.1.3. Where we need to comply with a legal or regulatory obligation.
5.2. Generally, we do not rely on consent as a legal basis for processing your personal data. This is because in most cases the processing is required to perform the contract with you, or, because it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.

8.1. We may use your Account, Profile, Technical and Usage Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you.
8.2. You will receive marketing communications from us if you have requested information from us or purchased goods or services from us or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, you have not opted out of receiving that marketing.

10.1. You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us at any time.
10.2. Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.
11. If you fail to provide personal information
If you fail to provide certain information when requested, the Company may not be able to perform any contract we have entered into with you or we may be prevented from complying with our legal obligations.
12. Change of purpose
12.1. We will only use personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
12.2. Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
13. Disclosure of your information to others
13.1. We may disclose your personal information to:
13.1.1. Any member of our Group insofar as reasonably necessary for the purposes, and on the legal grounds, set out in this privacy policy.

13.1.3. A purchaser in circumstances where the Company or substantially all of its assets are acquired by a third party, in which case personal data held by the Company will be one of the transferred assets.

13.1.4.1. who supply goods and/or services to the Group in order that Group may perform its contractual, legal and other obligations including, but not limited to, our suppliers and sub-contractors, service providers, distribution services, telemarketing services, debt collection services;

13.1.4.2.3. to assist us in improving our products and services. We monitor aggregated data that is collected by our Service and may share this with third parties collectively and in an anonymous way. This data will not reveal personal information
13.1.5. We will disclose Transaction Data to :
13.1.5.1. our payment service provider to the extent necessary for the purposes of processing payments, arranging refunds, dealing with complaints and queries. Our payment service providers’ will process certain data in accordance with the terms of their own privacy policy details of which can be supplied on request.
13.1.6. We will disclose Profile Data, Transaction Data, Attendee Data, Marketing and Communications data and Enquiry Data to:
13.1.6.1. One or more selected third party service providers who assist us with our activities, such as hosting providers, and other IT or payment service providers, may also have access to personal information held by us and may use this information on our behalf.
13.1.6.2. We may authorise third parties to market their products and services to you. However, we only do this if you have indicated that you are happy for us to do so, and we only do it within the industrial sector. Your Personal Data will not leave the Company’s control and the third party never sees or handles your data. We receive the communication content from the third party and then send it to you on their behalf.

15. International Transfers
15.1. Many of our external third parties are based outside the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the EEA.

16. Security
16.1. You acknowledge the transmission of information via the internet is not completely secure. Although the Company will do its best to protect your personal data, the Company cannot guarantee the security of your data transmitted via the Site; any transmission is at your own risk and we cannot prevent the use (or misuse) of such personal data by others. Once the Company has received your information, the Company will use strict procedures and security features to try to prevent unauthorised access.
16.2. We are committed to ensuring that your information is secure. We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. 17. How long we will retain your Personal Data

18. Your rights as a data subject
Under certain circumstances, you have rights under data protection laws in relation to your personal data. We summarise below the rights which you have under GDPR effective from 25th May 2018. Your rights under the Act remain unaffected in the interim
19. No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
20. What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
21. Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
22. You have the right to:
22.1. Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
22.2. Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
22.3. Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
22.4. Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

23.1. You should be aware that information may be collected using cookies, whenever accessing our Site or any Group websites. We use traffic log cookies to identify which pages are being used. This helps us analyse data about webpage traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system. Cookies help us provide you with a better website by enabling us to monitor which pages you find useful and which you do not.
